Terms of Service

§1. Definitions

1.1. Service Provider — Wojtek Kibitlewski, operating a business at ul. Śnieżyczek 11A, Katowice, Poland, Tax ID: 8441087460, email: sales@thesignalscout.com, the operator of the Service.

1.2. Service — the theSignalScout platform available at thesignalscout.com, including all features, tools, and services offered through it.

1.3. User — a natural person conducting a business or professional activity, a legal entity, or an organizational unit without legal personality that uses the Service for purposes related to their business or professional activity.

1.4. Account — the User's individual account in the Service, protected by login credentials, enabling access to the Service's functionalities.

1.5. Monitored Profiles — LinkedIn profiles of individuals or companies added by the User for monitoring within the Service.

1.6. Public Data — publicly available information from the LinkedIn platform, including post content, profile data, and engagement statistics, independently sourced by the Service Provider from publicly accessible sources.

1.7. Alert — an email notification sent to the User when AI analysis detects a post with a high match to the User's business profile.

1.8. Scoring — a match rating of a post to the User's business profile on a scale of 1–5, generated automatically by artificial intelligence.

1.9. Plan — the subscription tier selected by the User (Starter, Pro, or Pro All-in), defining the scope of available features and limits.

1.10. AI — artificial intelligence technologies used within the Service for analyzing, summarizing, and scoring content.

§2. General Provisions

2.1. These Terms of Service define the rules for using the Service, as well as the rights and obligations of Users and the Service Provider.

2.2. The Service is intended exclusively for entities conducting business or professional activities (B2B). By using the Service, the User represents and warrants that they are acting for purposes related to their business or professional activity and not as a consumer. Accordingly, consumer protection provisions, including the right of withdrawal from a distance contract, do not apply.

2.3. Use of the Service constitutes acceptance of these Terms. If the User does not agree with these Terms, they should not use the Service.

2.4. The Service Provider reserves the right to modify these Terms. Users will be notified of material changes at least 14 days in advance via email or through a notice within the Service. Continued use of the Service after the changes take effect constitutes acceptance.

§3. Registration and Account

3.1. Use of the Service requires creating an Account. During registration, the User is required to provide truthful, current, and complete information.

3.2. The User is solely responsible for maintaining the confidentiality of their login credentials and for all activity on their Account. The User agrees to promptly notify the Service Provider of any unauthorized access to their Account.

3.3. Each Account may only be used by one individual. Sharing login credentials with third parties is prohibited.

3.4. The Service Provider reserves the right to suspend or delete the Account of a User who violates the provisions of these Terms, without prior notice in cases of gross violations.

§4. Description of the Service

4.1. Scope. theSignalScout enables Users to monitor publicly available content published on LinkedIn by selected profiles of individuals and companies. The Service automatically analyzes this content using AI, generates summaries, scores the match to the User's business profile, and sends email Alerts when a post with a high Score is detected.

4.2. Data sourcing. Data presented in the Service is independently sourced from publicly available online sources. The Service does not use the User's LinkedIn account to collect, scrape, or obtain any data. The User is not required to provide their LinkedIn login credentials.

4.3. No LinkedIn automation. The Service does not send messages, publish posts, send connection requests, like, comment, or perform any other automated actions on the LinkedIn platform on behalf of the User.

4.4. Informational nature. Information presented in the Service, including AI summaries, Scoring, and Alerts, is for informational and supportive purposes only. It does not constitute business, legal, or other professional advice. The User makes business decisions based on information from the Service at their own risk.

4.5. No completeness guarantee. The Service Provider does not guarantee that the Service will detect all posts published by Monitored Profiles, or that AI analysis will always be complete or accurate. AI analysis results may contain errors, inaccuracies, or omissions.

4.6. Availability. The Service Provider uses reasonable efforts to ensure continuous operation of the Service but does not guarantee uninterrupted availability. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond the Service Provider's control.

§5. AI Data Processing

5.1. As part of providing the Service, LinkedIn post content is processed through third-party artificial intelligence application programming interfaces (AI APIs), including services provided by OpenAI, for the purpose of generating summaries, scoring matches, and creating Alerts.

5.2. The Service Provider uses a single platform API key for AI data processing. The User is not required to provide their own API key.

5.3. Content submitted to AI APIs includes only publicly available LinkedIn post content and the User's business description. The User's personal data (such as email address, password) is not transmitted to AI providers.

5.4. The Service Provider does not control how data is processed by third-party AI providers and is not responsible for their actions. Information about AI providers' data processing practices is available in their respective terms and privacy policies.

§6. Plans and Payments

6.1. Available Plans. The Service offers the following Plans:

  • Starter (free) — up to 3 Monitored Profiles, scanning 2x daily, email Alerts, AI summaries.
  • Pro (99 PLN/month) — up to 100 Monitored Profiles, scanning 2x daily, email Alerts + daily digest, AI summaries + Scoring, data export (CSV).
  • Pro All-in (199 PLN/month) — up to 200 Monitored Profiles, scanning 2x daily, email Alerts + daily digest, AI summaries + Scoring, data export (CSV), comment analysis, company information summaries, early access to new features.

6.2. Pricing. Prices are listed in Polish zloty (PLN), net (excluding VAT), unless stated otherwise. Applicable VAT will be added in accordance with current regulations.

6.3. Payments. Payments for paid Plans are processed on a monthly cycle through a payment processor (e.g., Stripe). The User authorizes the Service Provider and the payment processor to charge the designated payment method.

6.4. Auto-renewal. Subscriptions automatically renew for the next billing period at current prices, unless the User cancels the subscription before the end of the current period.

6.5. Plan changes. The User may change their Plan at any time. Upgrading activates immediately. Downgrading takes effect at the beginning of the next billing period.

6.6. Price changes. The Service Provider reserves the right to change Plan prices. Users will be notified of price changes at least 30 days in advance. Price changes take effect from the next billing period.

§7. Cancellation and Refunds

7.1. Cancellation. The User may cancel their subscription at any time in Account settings. Cancellation stops future renewals. Access to paid Plan features is maintained until the end of the paid billing period.

7.2. No refunds. Subscription fees are not refundable for unused periods. After cancellation, the User retains access to the Service until the end of the current billing period.

7.3. Exception — technical failure. If a severe technical failure on the Service Provider's side prevents use of the Service for a period exceeding 48 hours (after written notification by the User), the Service Provider may, at its sole discretion, grant a pro-rata refund or extend the subscription period.

§8. LinkedIn Data — User Representations and Liability

8.1. User representations. By using the Service, the User represents and warrants that:

  • a) they add only publicly accessible LinkedIn profiles for monitoring;
  • b) they use information obtained from the Service in compliance with applicable law, including data protection regulations (GDPR);
  • c) they will not use data obtained from the Service for unlawful purposes, including spam, stalking, harassment, phishing, or discrimination;
  • d) they are solely responsible for how they use information, Alerts, and analyses provided by the Service;
  • e) they are aware that the use of publicly available data from LinkedIn may be subject to LinkedIn's terms of service, and they accept the risks arising therefrom.

8.2. Limitation of Service Provider's liability. The Service Provider shall not be liable for:

  • a) how the User uses information obtained from the Service;
  • b) the User's violation of LinkedIn's terms of service or the rights of third parties;
  • c) any actions taken by the User based on Alerts or analyses provided by the Service;
  • d) the accuracy, completeness, or timeliness of data sourced from publicly available sources.

§9. Prohibited Use

9.1. The User agrees not to engage in any of the following activities in connection with the use of the Service:

  • a) scraping, extracting, or replicating data from the Service outside the provided functionalities;
  • b) attempting to reverse engineer, decompile, or disassemble the Service;
  • c) sharing login credentials with third parties or enabling unauthorized access to the Account;
  • d) using the Service in a manner that violates applicable law or the rights of third parties;
  • e) using the Service for mass collection of personal data for purposes unrelated to the User's business activity;
  • f) reselling, sublicensing, or making the Service available to third parties without the Service Provider's written consent;
  • g) using data from the Service to build a competing product or service;
  • h) taking actions that could disrupt the Service's operation, overload its infrastructure, or compromise the security of other Users' data.

§10. Intellectual Property

10.1. The Service, including its appearance, design, source code, algorithms, content, and materials, is the property of the Service Provider or its licensors and is protected by copyright, industrial property, and other intellectual property laws.

10.2. The User receives a limited, non-exclusive, non-transferable, and revocable license to use the Service solely for their own business or professional activity, in accordance with the terms of the selected Plan.

10.3. Nothing in these Terms transfers any intellectual property rights in the Service to the User.

§11. Data Protection

11.1. The processing of Users' personal data is governed by a separate Privacy Policy.

11.2. The following categories of data are processed in connection with providing the Service:

  • a) User Data — name, email address, password (encrypted), payment data, business activity description, language preferences;
  • b) Public Data — publicly available information from Monitored Profiles' LinkedIn profiles, including names, job titles, company names, post content;
  • c) Generated Data — AI summaries, Scoring results, Alert history.

11.3. The Service Provider does not sell User data to third parties.

11.4. Data is stored on servers located within the European Union, with the exception of transfers to AI providers (e.g., OpenAI) located in the United States, based on appropriate data transfer mechanisms compliant with GDPR.

§12. Disclaimers and Limitation of Liability

12.1. "As is" service. The Service is provided on an "as is" and "as available" basis, without any warranties, express or implied, to the fullest extent permitted by law.

12.2. Disclaimer of liability. To the fullest extent permitted by applicable law, the Service Provider shall not be liable for:

  • a) indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, business opportunities, or goodwill;
  • b) acts or omissions of third parties, including AI providers, payment processors, or the LinkedIn platform;
  • c) interruptions in the Service's operation caused by factors beyond the Service Provider's control;
  • d) the User's business decisions made based on information from the Service.

12.3. Liability cap. The Service Provider's total aggregate liability to the User for all claims related to the Service in any 12-month period shall be limited to the greater of: (a) the total amount paid by the User for the Service during that period, or (b) PLN 500.

12.4. The above limitations do not exclude or limit liability for damages caused intentionally, for death or bodily injury resulting from negligence, or for any other liability that cannot be limited under applicable law.

§13. Indemnification

13.1. The User agrees to indemnify, defend, and hold harmless the Service Provider, its employees, contractors, and subcontractors from any claims, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to:

  • a) the User's violation of these Terms;
  • b) the User's violation of applicable law or the rights of third parties;
  • c) how the User uses data, Alerts, and analyses provided by the Service;
  • d) claims from third parties related to Monitored Profiles added by the User.

§14. Force Majeure

14.1. The Service Provider shall not be liable for any failure or delay in performing obligations under these Terms if caused by force majeure events, including but not limited to: natural disasters, wars, epidemics, pandemics, strikes, telecommunications failures, power outages, government actions, changes to third-party platform terms or APIs (including LinkedIn), or other events beyond the Service Provider's control.

§15. Account Deletion and Data Removal

15.1. The User may delete their Account at any time through the Service's settings or by contacting the Service Provider.

15.2. After Account deletion, the Service Provider will delete the User's data within 30 days, subject to data retention obligations under applicable law (e.g., billing records).

15.3. Account deletion does not entitle the User to a refund for unused subscription periods.

§16. Newsletter and Marketing Communications

16.1. The User may consent to receiving the newsletter and marketing communications during registration or in Account settings.

16.2. The User may withdraw consent to marketing communications at any time in Account settings or through the unsubscribe link included in each message.

16.3. Withdrawing consent to the newsletter does not affect the User's ability to use the Service or the delivery of service-related notifications (e.g., Alerts, Terms changes, payment notifications).

§17. Governing Law and Dispute Resolution

17.1. These Terms shall be governed by Polish law.

17.2. Any disputes arising from these Terms or the use of the Service shall first be addressed through good faith negotiations. If an amicable resolution is not reached within 30 days of notifying the dispute, the dispute shall be submitted to the competent court for the Service Provider's registered address.

§18. Miscellaneous

18.1. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

18.2. The Service Provider's failure to enforce any right under these Terms shall not constitute a waiver of that right.

18.3. The User may not transfer their rights and obligations under these Terms to third parties without the Service Provider's written consent.

18.4. The Service Provider may transfer its rights and obligations under these Terms to a third party, provided this does not adversely affect the User's rights.
